Terms and Conditions

1. General
The following Terms and Conditions apply exclusively to the business relationship between Rodenberg amplification and the buyer, in the version valid at the time of the order. We do not recognize any conflicting or deviating terms and conditions of the purchaser unless expressly agreed in writing.
All information and offers regarding devices and product descriptions are non-binding. Printing errors and mistakes are reserved. Due to ongoing technical development and product improvement, we reserve the right to make changes to design and construction.
RODENBERG amplification reserves the right not to provide the promised service if, after conclusion of the contract, it becomes apparent that the goods are not available despite a corresponding covering transaction. In such cases, the customer will be informed immediately and any payments already made will be refunded without delay. Further claims against RODENBERG amplification are excluded.
2. Delivery
Delivery is subject to correct and timely self-supply, provided that we are not responsible for the lack of availability. Claims for damages, including those due to delayed or incomplete delivery, are excluded unless gross negligence is involved.
Delivery times are generally non-binding unless a specific delivery period has been agreed in writing. Delivery is at the customer’s risk. The risk passes to the customer as soon as the goods are handed over to a transport company. This also applies to partial deliveries.
Delivery is made to the delivery address specified by the customer. Deliveries are made within Germany, within the EU, and outside the EU (export trade). VAT is generally deducted for deliveries outside the EU.
Goods must be inspected immediately upon receipt for transport damage. Obvious transport damage must be reported in writing without delay. Packaging damage must be confirmed in writing by the transport company upon acceptance of the goods.
3. Prices and Payment
All prices are cash prices including 19% VAT plus any applicable packaging and transport costs. Shipping costs depend on the item/order and delivery destination and will be communicated in writing or by email prior to invoicing and payment.
As a rule, we ship only against advance payment unless another payment term has been expressly agreed in writing. In the case of direct debit, the due amount will be collected from the agreed account without deduction three days after delivery.
The goods remain the property of RODENBERG amplification until full payment has been made. In the event of default, statutory default interest of 5 percentage points above the base interest rate (§§ 288, 247 BGB) will be charged. We also reserve the right to withdraw from the contract in accordance with statutory provisions.
4. Retention of Title
The goods remain the property of RODENBERG amplification, Goldäcker 3, 36124 Eichenzell,Germany until full payment has been received.
5. Right of Withdrawal
Consumers have the right to withdraw from the contract within two weeks without stating reasons, in text form (e.g. letter, email) or by returning the goods.
The withdrawal period begins on the day after receipt of the goods. The goods must be returned in proper condition and without signs of use. The right of withdrawal is excluded for goods manufactured according to customer specifications.
If the returned goods have decreased in value due to use by the customer, RODENBERG amplification may claim compensation. Defects or damage caused by improper handling or use by the customer or third parties are excluded from warranty.

6. Warranty
The warranty period for delivered goods is 24 months from receipt. Otherwise, statutory warranty provisions apply. Any further liability for damages is excluded. The provisions of the Product Liability Act remain unaffected.
Warranty claims must be asserted within the warranty period. The product must be returned together with the original invoice. At our discretion, defective products will be repaired or replaced.
Warranty does not apply to:
used products; products subject to normal wear and tear; damage caused by improper use, failure to follow operating instructions, overload, lack of maintenance or care; damage caused by non-original accessories or parts. Tubes are excluded from any warranty.
Returns must be made free of charge to RODENBERG amplification. Otherwise, warranty claims will not be accepted unless return shipping has been confirmed in writing in advance. Repaired or replaced goods will be returned free of charge to the customer.
7. Liability
Claims for damages due to defects are excluded unless RODENBERG amplification has fraudulently concealed the defect, assumed a guarantee, or caused damage to life, body or health.
Any liability beyond statutory provisions is excluded, regardless of legal grounds, unless based on intent or gross negligence. Contracts are governed exclusively by the substantive law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), even if the customer is based outside Germany.
8. Place of Performance and Jurisdiction German law applies exclusively. The place of performance for all services is Fulda, Germany.
9. Final Provision
If individual provisions of these Terms and Conditions are or become invalid, the validity of the remaining provisions shall remain unaffected.
